Principle Agreement

Employers will create their accounts with a username and password to use the services on the JapanViec.com.vn website according to the registered service package. Employers are responsible for the security of their login credentials and should use the account solely for their recruitment purposes. In case employers lose or forget their passwords, immediate notification to JapanViec.com is required for timely assistance.

 

Once the Employer signs a Contract or Order and/or JapanViec.com activates the service according to the signed Contract or Order, the Employer is not allowed to request changes to the service. At the same time, the Employer must fully take responsibility for the use of their services.

Employers will post their job advertising information and/or reference their website address on JapanViec.com. Employers will bear full responsibility for the accuracy and legality of the content of their recruitment advertising information posted on JapanViec.com and/or related recruitment content on the referenced website.

 

Employers are only allowed to use and exploit information related to the services according to the Order/Contract with JapanViec.com for their recruitment purposes. Employers are not permitted to disclose, share, or sell any candidate information obtained to any third party in any form, as stipulated by applicable laws.

 

The services purchased in the Contract/Order are to be used by the Employer with the Payment Information on the Contract/Order (excluding affiliated companies or subsidiaries). The recruitment content must be in line with the business license registered by the Employer.

 

In the case that the Employer violates the provisions herein, JapanViec.com reserves the right to remove any posted content of the Employer and terminate this Order/Contract without refunding the service fees that the Employer has paid but not yet used. Additionally, depending on the level of violation, JapanViec.com will report the violation to the relevant government authority and/or require the Employer to compensate for any damages arising from the Employer’s violation.

 

If JapanViec.com detects any signs of violation related to these regulations by the Employer, JapanViec.com has the right to temporarily remove all content and links of the Employer and notify the Employer. Depending on the specific terms and conditions in the Contract/Order, in the event that JapanViec.com unilaterally terminates the Order/Contract, the Employer will be refunded the service fees that the Employer has paid but not yet used.

 

Through the signing of Contracts/Orders/Agreements, the Employer agrees to allow JapanViec.com to use the Logo and Brand for Marketing Campaigns to promote the employer’s job positions to potential candidates and users.

 

Each job position should be posted only once and should be reposted after 30 days when the current job posting has expired. In the case where the Employer needs to post a new job, the current job posting for a similar position should be deactivated. JapanViec.com will check and deactivate duplicate job postings without prior notice to the Employer.

 

All information posted by the Employer on JapanViec.com and its partner websites should not mention or disparage competitors. JapanViec.com reserves the right to refuse or remove any content related to this regulation.

 

Regulations for Job Postings

A - Regarding Job Position/Job Description/Job Requirements:

  • Modifications are not allowed after the job has been posted on JapanViec.com.
  • Each job posting is only for one (1) job position with corresponding job description and job requirements.
  • The first letter of each word must be capitalized (e.g., Sales Manager). For abbreviations, all letters must be capitalized (e.g., DHKK, ERP, CAD, .NET, PCCC…).
  • Limit the simultaneous use of English, Vietnamese, and Japanese for one job position (e.g., Management Accountant,  Purchasing Staf).
  • Do not combine multiple languages in the job position section as it may cause difficulties for candidates in searching for your job (e.g., Nhân viên Technical máy tính), except for the following cases:
  • No accurate Vietnamese description for the job (e.g., ERP Employee, ISO specialist, .NET developer)
  • Common English Phrases (e.g., QC Employee, M&E Engineer)
  • Words and phrases such as "Recruiting", "working at", "department"; information such as the number of positions, workplace location, products, target candidates, department, salary, language, gender, etc., must be expressed in the job description or appropriate provided fields and should be removed from the job position section.

B - Regarding Job content:

  • Must contain detailed and comprehensive information about the job: Description, requirements, benefits, and other useful information.
  • Requirements should be written as separate sentences, not in a paragraph. Eliminate phrases like "Job details will be discussed during the interview"; "information will be provided during the interview"; URLs and links.
  • Do not include contact information such as phone numbers or email addresses in the job description.

C - Prohibited advertising Products, Goods, Services:

  • Goods and services prohibited by law.
  • Tobacco products.
  • Alcoholic beverages with an alcohol content of 150 degrees and above.
  • Substitute milk products for infants under 24 months, nutritional supplements for infants under 6 months; artificial feeding bottles and artificial nipples.
  • Prescription drugs; non-prescription drugs recommended by authorized state agencies to be restricted or used under the supervision of a doctor.
  • Products with aphrodisiac properties.
  • Hunting guns and ammunition, sports weapons, and products with a propensity for inciting violence.
  • Other products, goods, or services prohibited from advertising by the Government due to specific regulations to meet practical requirements.

 

PROTECTION OF PERSONAL DATA

All parties must comply with the regulations on the protection of personal data at all times.

 

Employers must use personal data obtained through services provided by JapanViec.com (hereinafter referred to as "Personal Data," as defined in Decree No. 13/2023/ND-CP on Personal Data Protection) according to the terms and conditions of the contract/order/collaboration agreement, usage terms, and the personal data protection policy of JapanViec.com, updated as necessary.

 

Employers may only use Personal Data for the purposes specified in the contract/order/collaboration agreement and are prohibited from providing, disclosing, leaking, or using Personal Data for any purposes other than those agreed upon with third parties.

 

Employers must take necessary measures to maintain the security of Personal Data, such as entering into security agreements with employees, customers, or subcontractors, and implementing measures to manage Personal Data.

 

JapanViec.com may request measures that it deems necessary to process Personal Data beyond the measures mentioned in the previous sections, and Employers will comply with those requirements.

 

JapanViec.com may request Employers to provide necessary documents or papers to verify compliance with the measures required for managing Personal Data.

 

If the Employer signs a contract/order/collaboration agreement subcontracting part of the recruitment work to other subcontractors or provides recruitment services to other entities, the Employer must ensure that those entities comply with similar security obligations as stipulated in this provision.

 

If the Employer copies or modifies Personal Data beyond the scope of recruitment purposes, the Employer must obtain the prior written consent of JapanViec.com or the data subjects ("Data Subjects" as defined in Article 2.6 of Decree No. 13/2023/ND-CP on Personal Data Protection).

 

After terminating this contract/order/collaboration agreement, the Employer must ensure the security of all Personal Data obtained or generated during the term of the contract/order/collaboration agreement and must transfer it back to JapanViec.com, delete, destroy, or take other appropriate measures as instructed by JapanViec.com (if applicable).

 

When collecting Personal Data for the Employer’s own recruitment purposes, the Employer must process Personal Data in an appropriate and lawful manner within the necessary scope to achieve this purpose.

 

If the Employer violates any provision set forth herein without just cause, JapanViec.com may terminate the contract/order/collaboration agreement. In this case, JapanViec.com may request the Employer to compensate for damages. In the event that the Employer and/or its subsidiaries violate the provisions of personal data protection, the Employer will bear all responsibility, obligations, and compensate for all losses and damages incurred by JapanViec.com and/or any third party. The Employer shall keep JapanViec.com unaffected and indemnified from any claims, complaints, legal actions arising from the violation of the Employer / its subsidiaries.

 

If the Employer becomes aware of the existence of events indicating criminal violations related to the processing of personal data in the course of the entrusted business activities by participating parties or those who have participated in the delegated business activities, the Employer must promptly report such cases (and in any case within 24 hours) to JapanViec.com. This notification must include the following information:

  • Description of the violation, including the time, location, actions, organizations, individuals, classification, and quantity of relevant data.
  • Contact information of personnel assigned to protect personal data or organizations/individuals responsible for protecting personal data.
  • Description of the consequences and potential damages that may occur due to the violation of personal data protection regulations.
  • Description of proposed measures to resolve and minimize the impact of the violation of personal data protection regulations.

This obligation will still apply even after the termination of the contract/order/collaboration agreement.

Dispute resolution process and responsibilities

In the event of a dispute between a member/applicant/employee (collectively referred to as the third party) and a company using the services of JapanViec.com, Lisod Japan Co., Ltd emphasizes the importance of negotiation and mediation solutions among the parties to maintain the third party’s trust in the quality of JapanViec.com’s services. We will proceed with the dispute resolution and complaint process as follows:

  • Step 1: JapanViec.com receives feedback from the third party regarding inaccurate job postings by companies using JapanViec.com services, or instances where companies use the service to approach and contact inappropriate candidates, such as marketing through email databases. Also, cases where third parties are charged without the fulfillment of agreed commitments or complaints related to the legal responsibilities of companies using JapanViec.com services.
  • Step 2: The Customer Care or Sales Department of Lisod Japan Co., Ltd receives the feedback from the third party. These departments actively gather additional detailed information from the third party and respond with the resolution results of the complaints based on the policies published by the Company. We reserve the right to temporarily suspend job postings or related services immediately without approval from the companies using JapanViec.com services and inform them of relevant information within 8 working hours.
  • Step 3: In cases where companies using JapanViec.com services do not provide authentic information or if these companies and the third party fail to reach an agreement through negotiation, JapanViec.com reserves the right to temporarily suspend job postings or cease providing services until the dispute between these companies and the third party is satisfactorily resolved.

In any case, Lisod Japan Co., Ltd is exempt from legal responsibility related to disputes between companies using the services of JapanViec.com and third parties regarding any arising complaints or disputes.

 

Termination

The Company reserves the right, at its sole discretion, to take all legal measures, including but not limited to managing and/or removing your posts from this website and other JapanViec.com websites, and immediately terminating your registration with or access to this website and other JapanViec.com websites and/or any other services provided by the Company to you when you violate these Terms and Conditions or if the Company cannot verify or authenticate any information you submit to the website or other JapanViec.com websites.
